BGH 11. Zivilsenat rejects plaintiff's leave-to-appeal complaint; § 543 Abs. 2 ZPO standard not met
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the refusal of leave to appeal, thereby upholding the lower court's prior decision and leaving the plaintiff to bear the costs of the complaint proceedings. The dispute involved a civil matter reviewed under § 543 ZPO, where the appellant challenged the appellate court's rejection of their application for leave to appeal on grounds of fundamental significance, the need for the further development of law, and the assurance of uniform jurisprudence. The court determined that the case lacked fundamental significance and did not require the Revisionsgericht to intervene for legal development or uniformity, noting that it had also assessed and negated the prospects of success for a full revision appeal; the decision was rendered without further reasoning pursuant to § 544 Abs. 6 Satz 2 Halbs. 2 ZPO, relying on preceding rulings by the same senate, with the value in dispute set at up to €30,000.
