Rejection of non-admission of revision due to lack of fundamental legal significance in civil proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiffs' application for the suspension of proceedings and dismissed their complaint against the non-admission of revision, thereby upholding the lower court's decision. The dispute involved a challenge to a procedural ruling by the 19th Civil Senate of the Munich Higher Regional Court, where the plaintiffs sought admission of an appeal to the BGH. The court held that the case lacked fundamental legal significance and that the development of law or ensuring uniform jurisprudence did not require a decision by the revision court, relying on § 543 Abs. 2 Satz 1 ZPO and referencing a prior ruling of March 31, 2020. Consequently, the BGH declined to provide further reasoning pursuant to § 544 Abs. 6 Satz 2 Halbs. 2 ZPO and ordered the plaintiffs to bear the costs of the complaint proceedings, setting the value of the litigation at up to 25,000 EUR.
