Withdrawal of non-admission complaint renders auxiliary party appeals moot; cost allocation for withdrawn extraordinary remedy
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure declared the defendant's non-admission complaint for verdict forfeit after the defendant withdrew the appeal, and ruled that the simultaneous appeals filed by four auxiliary parties became moot following the defendant's extrajudicial commitment to withdraw; consequently, the defendant bears the costs of the non-admission complaint, while the auxiliary parties bear the costs associated with their separate intervention. The dispute arose from the defendant's attempt to challenge the lower court's judgment of April 28, 2022, via a non-admission complaint. The decisive procedural basis was the defendant's voluntary withdrawal of the primary appeal, which rendered the auxiliary parties' parallel appeals moot and dictated the allocation of litigation costs according to the German Code of Civil Procedure.
