The Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, thereby upholding the Regional Court of Appeals' decision and leaving the lower court's ruling in force; the defendant bore the costs of the appeal, with the amount in dispute capped at €22,000. The dispute concerned a challenge to a civil judgment where the defendant argued that the issues of legal principle and the quantification of the claim required a higher court review. The BGH held that the complaint failed to demonstrate a need for legal clarification beyond the established principles set forth in its 2018 judgment (VI ZR 295/17), nor did it prove that the disputed questions regarding the claim's quantum were decisive for the outcome. The decision relied on §§ 543(2) sentence 1 and 544(6) sentence 2 half-sentence 2 of the German Code of Civil Procedure (ZPO) for non-admission and cost allocation under § 97(1) ZPO.
