Admissibility of civil revision complaint and lack of fundamental legal significance in personal injury liability
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of a revision, thereby upholding the appellate court's judgment in favor of the third defendant. The dispute concerned a liability claim where the appellate court independently grounded its decision on the finding that the defendant was not at fault. The BGH ruled that the case lacked fundamental legal significance and did not require the revision court to develop the law or ensure uniform jurisprudence, and it rejected the alleged violations of procedural fundamental rights as unfounded. The decision was issued based on §§ 543(2) sentence 1 and 544(6) sentence 2 half-sentence 2 ZPO, with the plaintiff bearing the costs of the complaint proceedings and the amount in dispute set at 65,000 euros.
