Admissibility of compensation claim against engine manufacturer for alleged participation in vehicle manufacturer's emission standard violations
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice dismissed the plaintiff's complaint for leave to appeal, thereby upholding the lower court's rejection of his tort claim and establishing that he did not prevail. The dispute concerned a claim under Section 823(2) BGB in conjunction with automotive emission standards, where the plaintiff alleged a deliberate legal violation by a vehicle manufacturer in which the defendant, identified solely as an engine manufacturer, had participated. The court held that the plaintiff failed to adequately demonstrate the relevance of the alleged legal violation to the specific status of the engine manufacturer, distinguishing the defendant from the direct vehicle manufacturer, and found that the case lacked fundamental legal significance or a need for uniform case law to justify a revision hearing.
