Habitual document forgery under § 267 Abs. 3 StGB: Intent to secure continuous income through false license plates used for theft
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the defendant's appeal as unfounded, upholding the lower court’s conviction for habitual document forgery and ordering the defendant to bear the costs of the appeal. The case involved the use of a false official license plate belonging to a different vehicle on a car utilized for theft attempts, where the defendant argued the specific count of habitual document forgery under § 267 (3) Sentence 2 No. 1 StGB was not sufficiently supported by the facts. The court determined that the intent to commit the forgery with the purpose of securing a continuous source of income through repeated criminal acts was established, as the use of the forged document served to secure the removal of stolen goods and facilitate further profitable thefts, thereby satisfying the legal requirements for "gewerbsmäßig" (habitual/commercial) conduct under German criminal law.

Gewerbsmäßige Urkundenfälschung
[TENOR]
