Continued validity of auxiliary victim’s procedural standing and court-appointed counsel through the appellate instance
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Justice (4th Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the final judgment of the Regional Court of Bremen dated September 25, 2025, and ordered the appellant to bear the procedural costs and the necessary expenses incurred by the auxiliary victim in the appellate proceedings. The dispute arose from a criminal trial where the defendant challenged the first-instance verdict, but the appellate review found no legal errors to the defendant's detriment under § 349 Abs. 2 of the Code of Criminal Procedure (StPO). In a supplementary remark, the court clarified that the auxiliary victim's procedural standing, based on a valid joinder declaration and court-appointed counsel, remained in effect through the appellate instance.

August 2012 - 2 StR 322/12).
