Liability of engine manufacturer for vehicle emissions violations under tort law and EU fuel regulations
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, rejecting the claim and leaving the appellate court's decision in force. The dispute concerned a tort claim arising from automotive emissions regulations, where the plaintiff, as a vehicle owner, sued a component manufacturer (engine supplier) for damages, alleging a violation of statutory prohibitions. The court held that the plaintiff failed to demonstrate the requisite legal error or fundamental significance for revision; specifically, the plaintiff did not sufficiently substantiate that the component manufacturer had participated in a deliberate statutory violation by the vehicle manufacturer, nor did it prove that the alleged procedural fundamental rights violations were effective. The decisive legal basis involved §§ 823, 826, and 31 of the German Civil Code (BGB) in conjunction with § 6(1) and § 27(1) of the Emissions Gasoline Vehicles Regulation (EG-FGV), applied under § 543(2) and § 544(6) of the Code of Civil Procedure (ZPO) for the determination of admissibility and costs.
