The Federal Court of Justice (5th Criminal Senate) dismissed the appeals of the defendants as unfounded, rejecting the criminal revision filed against the judgment of the Kiel Regional Court of 24 September 2025; the lower court’s conviction stands, and each appellant is ordered to bear the costs of their legal remedies and the necessary expenses incurred by the civil parties during the appeal proceedings. The dispute centered on procedural violations, specifically a complaint alleging a breach of § 261 StPO (the principle that the judge’s knowledge of the case must derive from the main hearing), where the appellant argued that the court failed to exhaust available evidence or improperly considered procedural material not introduced during the main hearing. The Court held that the appeal was inadmissible because it failed to provide a specific direction of attack by not clearly identifying the alleged legal errors, and furthermore, a supplementary review revealed no obvious contradictions between the cited, non-introduced police interrogation transcriptions of the victim and the content of the judgment, as the appellant’s arguments merely consisted of a selective and subjective re-evaluation of excerpts.

Volltext
