The Federal Court of Justice (I ZB 74/23) dismissed the applicant’s appeal as inadmissible and rejected their application for legal aid, ruling that the applicant bore the costs; consequently, the Landgericht Trier’s decision of 29 November 2023 remains in force. The dispute concerned a procedural challenge in interim injunctive proceedings, where the applicant attempted to appeal the lower court’s ruling by way of a *Rechtsbeschwerde* and sought the appointment of counsel for free legal aid or as a necessary lawyer. The decisive legal basis for the decision was that an appeal by *Rechtsbeschwerde* is not a permissible legal remedy in interim injunctive proceedings (*einstweilige Verfügung*), rendering the main complaint inadmissible. Furthermore, the application for legal aid was denied because the intended litigation lacked sufficient prospect of success under § 114(1) sentence 1 ZPO, and the request for a necessary lawyer was refused as the case appeared hopeless under § 78b(1) ZPO.

Volltext

BGH, Beschluss vom 11. Januar 2023 - I ZB 120/22, juris Rn. 3; Beschluss vom 28. August 2023 - I ZB 48/23, MD 2023, 1063 [juris Rn. 4], jeweils mwN).
