Non-allowance of revision: inadmissibility of new evidence under § 580 Nr. 7 b ZPO when the appeal concludes the proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Justice dismissed the plaintiff's complaint against the non-allowance of revision, thereby upholding the final judgment of the Oberlandesgericht Hamm and leaving the plaintiff to bear the costs of the proceedings. The dispute centered on whether a document submitted by the defendant as new evidence during the non-allowance complaint proceedings could be considered to justify the admission of an appeal. The court held that new facts constituting a ground for restitution under § 580 Nr. 7 lit. b) ZPO may only be considered in revision or non-allowance proceedings if overriding public interests in the administration of justice require it, specifically to prevent further erroneous judgments in ongoing proceedings. Since the revision decision here would conclusively end the litigation, the court ruled that such new evidence could not be taken into account, as mere procedural economy is insufficient to override the statutory prohibition in § 559 ZPO, thereby denying the plaintiff's request for a legal review on the merits.

Dezember 2011 - XI ZR 75/11, juris, jeweils mwN).
Von einer weiteren Begründung wird gemäß § 544 Abs. 6 Satz 2 Halbs. 2 ZPO abgesehen.
Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
Der Gegenstandswert des Beschwerdeverfahrens beträgt bis 30.000 €.
