Motor Manufacturer Liability for Deliberate Statutory Violation in Vehicle Emissions Scandal
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiff's non-admission complaint, thereby upholding the appellate court's denial of a revision appeal and leaving the lower court judgments in force against the plaintiff. The dispute concerned the plaintiff's claims for damages against a defendant identified as a motor manufacturer, specifically challenging the appellate court's rejection of liability under §§ 826, 31 BGB and the refusal to find tortious liability under § 823 Abs. 2 BGB in conjunction with the Motor Vehicle Data Regulation (EG-FGV). The decisive legal basis was the court’s finding that the plaintiff failed to substantiate a deliberate statutory violation by the vehicle manufacturer that the motor manufacturer could have participated in, a requirement supported by prior BGH case law, and consequently demonstrated no basis for admission of revision or violation of procedural fundamental rights.
