The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's rejection of the plaintiff's damages claim. The dispute concerned an action for damages under § 823 Abs. 2 BGB in conjunction with § 6 Abs. 1 and § 27 Abs. 1 of the Food and Feed Law (EG-FGV), where the plaintiff alleged a tortious violation of law by a defendant acting as a motor manufacturer. The court held that the plaintiff failed to demonstrate that the defendant, as a motor manufacturer rather than a vehicle manufacturer, had intentionally participated in a statutory violation by the vehicle manufacturer, citing lack of relevance for the admissibility grounds and referencing precedent on the distinction between motor and vehicle manufacturers.
