The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, leaving the lower court's judgment in force; the plaintiff did not prevail in this appellate review. The dispute concerned claims for damages against a motor manufacturer, challenging the appellate court's rejection of liability under general intentional tort principles and statutory violations related to vehicle emissions regulations, specifically regarding the manufacturer's alleged participation in a vehicle manufacturer's intentional breach of law. The court found no grounds for admission of revision because the case lacked fundamental legal significance and the plaintiff failed to demonstrate the decision-relevance of the alleged legal errors, particularly regarding the distinct liability of a motor versus vehicle manufacturer; the complaint regarding violations of procedural fundamental rights was also deemed unsuccessful, and the plaintiff was ordered to bear the costs of the proceedings.

Volltext
