Civil liability dispute: admissibility of non-admission complaint and ex officio modification of instance value under GKG
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, leaving the lower court judgment in force and ordering the defendant to bear the costs of the proceedings. The dispute concerned a civil matter where the defendant challenged the appellate court's decision, arguing that the case raised questions of fundamental legal significance or required the development of law, but the court found no such basis for admission under § 543 Abs. 2 ZPO. The court also determined that the value in dispute for the complaint procedure was €61,442.00 and explicitly declined to modify the value of the appeal instance ex officio under § 63 Abs. 3 Satz 1 Nr. 2 GKG, reaffirming that filing a complaint for non-admission does not trigger the rules for the "main case."

Senat, Beschluss vom 24. März 2022 - V ZR 149/21, NJW 2022, 2195 Rn. 10).
