Failure to disclose procedural start date for mitigation: insufficiency of revision due to lack of record evidence for scope of initial prosecution notice
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the appeals of the defendants as unfounded against the judgment of the Munich I Regional Court of 12 May 2023, ordering each appellant to bear the costs of their legal remedy. The dispute centered on criminal fraud charges, where one defendant challenged the proceedings on the ground that the court failed to precisely specify the "age of the proceedings" as a statutory mitigating circumstance during pre-trial consultations, arguing the initial notice of proceedings did not cover the specific frauds under trial. The appellate court ruled that the procedural objection failed because the original notice from September 2019 concerned earlier offenses, not the current charges from 2018, and the defendant failed to provide any record evidence that the current allegations were part of that initial notice, failing to disclose relevant procedural steps from April 2021. The decision rests on §§ 349, 344, and 345 StPO, finding that the revision lacked the necessary substantiation and correct legal framing for a potential attack on the factual findings or exculpatory evidence.
