The Federal Court of Justice (BGH) 5th Criminal Senate dismissed the defendant’s appeal as unfounded, leaving the Landgericht Bremen’s judgment of 9 February 2023 in force, and ordered the defendant to bear the costs of the appeal and the necessary expenses of the auxiliary complainant. The case involved a criminal prosecution where the defendant challenged the conviction on appeal; additionally, the Public Prosecutor General had filed a request to correct the findings of fact for the first count of the indictment based on the temporal sequence of events. The court ruled that the defendant’s appeal contained no legal error to his detriment and held that the General Prosecutor’s request for a factual correction, which the Senate did not find justified, did not preclude the dismissal of the appeal by order under § 349(2) StPO, nor did the prosecutor’s reference to § 349(4) StPO alter this outcome.

Volltext

Juni 2022 – 5 StR 490/21; vom 21. November 2019 – 4 StR 158/19).
