Inadmissibility of unrepresented hearing complaint and manifestly unfounded recusal applications in BGH civil proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's hearing complaint and recusal applications as inadmissible, ruling against the plaintiff and ordering them to bear the costs. The dispute involved a procedural challenge where the plaintiff, acting without counsel, filed a hearing complaint against a prior court decision and simultaneously sought to recuse five judges on grounds of alleged bias. The court held the hearing complaint inadmissible because German civil procedure law mandates the representation by a lawyer admitted to practice before the Federal Court of Justice, a requirement that applies strictly to such procedural remedies. Regarding the recusal requests, the court determined they were "completely unsuitable" and abusive, as the justifications provided were inherently incapable of demonstrating bias from the outset; consequently, the judges were not required to remove themselves and the full panel of five judges, including those accused of bias, was competent to decide the matter by declaring it inadmissible without further examination of the substantive case.

[GRUENDE]
I. Die mit Schreiben vom 24.
Februar 2023 - I ZB 120/22, juris Rn. 1 mwN).
BGH, Beschluss vom 1. März 2023 - I ZB 88/22 u.a., juris Rn. 4 mwN). So liegt der Fall hier.
II. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO analog.
III.
