Strict standard of review for exact calculability of confiscation amounts in criminal revisions
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the appeals of the defendants as unfounded, leaving the judgment of the Landgericht Darmstadt from December 12, 2024, in full force, including the cost order against the appellants. The case involved a criminal appeal against a conviction and, specifically, the determination of the amount subject to confiscation, where the defendants challenged the lower court's sentencing and asset seizure measures. While the appellate court confirmed that the confiscation decision remained valid because a post-hoc review of the judgment’s overall context was possible, the BGH emphasized the strict legal standard required for such orders: unlike sentencing, which may rest on a minimum scope of guilt, the confiscation amount must be precisely calculable and error-free, requiring the judgment to explicitly detail the calculation bases and mathematical steps in a comprehensible manner to facilitate effective appellate review.

Volltext
BGH, Beschluss vom 13. Juni 2023 - 1 StR 126/23 Rn. 17).
