Legal aid for adhesion plaintiff in revision: no fresh financial declaration required and prospects of success exempt from review
Legislator-Zusammenfassung
KI-generiertThe BGH 6th Criminal Senate granted the adhesion plaintiff legal aid for the appeal instance without installment payments and appointed the already designated auxiliary counsel, with no change to the underlying criminal judgment. The dispute concerned an application for procedural legal aid in the revision stage of a criminal adhesion proceeding, where the applicant relied on a previously submitted declaration of financial circumstances stating no changes had occurred. The court determined that a new declaration using the prescribed form was not strictly required given the reference to the unchanged financial status, and explicitly held that it was not required to examine the prospects of success of the adhesion claim when granting legal aid, applying § 404 Abs. 5 StPO in conjunction with §§ 119 Abs. 1, 121 Abs. 2 ZPO, while reaffirming that legal aid awards are limited to the respective procedural instance.

BGH, Beschluss vom 19. Dezember 2018 - 4 StR 129/18, Rn. 2).
