Liability for distribution and management authority in prospectus-based claims under § 543 Abs. 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby affirming the lower appellate court’s judgment in favor of the defendants. The dispute concerned liability for damages where the plaintiff argued that a specific defendant bore distribution responsibility and managerial authority, facts which the appellate court found lacking as the prospectus identified a different entity as the distributor and the defendant possessed no such authority. The court held that the case lacked fundamental significance and did not require a decision by the supreme court to ensure uniform legal practice, citing its prior assessment that a revision would not succeed. Consequently, the operative order is the rejection of the complaint, leaving the appellate judgment in force, with the plaintiff ordered to bear the costs of the complaint proceedings.
