Non-admission of revision: Failure to demonstrate fundamental significance of legal questions under Art. 3(10) Regulation (EC) No. 715/2007
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against non-admission, thereby upholding the lower court's decision and leaving the plaintiff to bear the costs of the appeal. The dispute concerned a civil matter where the plaintiff challenged the Oberlandesgericht Stuttgart's refusal to admit a revision, arguing that the case involved questions of fundamental legal significance. The court held that the plaintiff failed to sufficiently demonstrate the relevance of the legal questions raised, specifically in relation to the preconditions of Article 3 No. 10 of Regulation (EC) No. 715/2007, and therefore the requirements for revision under § 543 Abs. 2 ZPO were not met.
