Psychiatric commitment appeal: right to be heard in dismissal of revision under § 349(2) StPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Justice (BGH) dismissed the accused's hearing complaint (*Anhörungsrüge*) against the appellate panel's decision, leaving the panel's order in force and placing the costs on the accused. The case concerned a criminal review (*Revision*) of a lower court judgment ordering the accused's placement in a psychiatric hospital, where the appellate panel had vacated the judgment except for findings on the external factual course of events and abstained from deciding on the adhesion application. The accused challenged this dismissal, alleging a violation of the right to be heard (*rechtliches Gehör*) by arguing the panel failed to address specific critiques regarding the speed determination evidence. The court held the complaint unfounded, ruling that no violation of the right to be heard occurs when the appellate panel unanimously agrees with the prosecution's view that the appeal is manifestly unfounded and dismisses it via order pursuant to § 349(2) Code of Criminal Procedure (StPO), as the accused has no right to have the specific reasons for rejecting their objections detailed in the dismissal order; costs were assessed under an analogous application of § 465(1) StPO.

BGH, Beschluss vom 5. Juni 2013 ‒ 1 StR 81/13 Rn. 4 mwN).
