Liability of Engine Manufacturer in Diesel Emissions Fraud: Absence of Deliberate Statutory Violation by Vehicle Manufacturer
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff’s non-admission complaint, upholding the appellate court’s decision against the plaintiff and ordering the plaintiff to bear the procedural costs. The dispute concerned claims for damages arising from the "Dieselgate" emissions scandal, where the plaintiff sought compensation against a defendant identified as an engine manufacturer. The appellate court had previously rejected claims based on intentional tort (§§ 826, 31 BGB) and tortious conduct violating statutory provisions (§ 823 Abs. 2 BGB in conjunction with the EU General Food Law), a ruling that remains in force following the BGH’s rejection of the admission of appeal for revision. The BGH held that the plaintiff failed to substantiate the decisive legal issues, specifically noting that as an engine manufacturer rather than a vehicle manufacturer, the defendant could not be held liable for a deliberate statutory violation by the vehicle manufacturer, and the complaint failed to demonstrate the relevance of the alleged grounds for admission.
