Admissibility of appeal against denial of tort liability for engine manufacturer's alleged participation in vehicle manufacturer's food law violations
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (VIa Civil Senate) dismissed the plaintiff's complaint for non-admission of appeal, rejecting the appeal and leaving the prior appellate decision in force. The dispute involved a claim under § 823 Abs. 2 BGB in conjunction with § 6 Abs. 1, § 27 Abs. 1 of the EU General Food Law, wherein the plaintiff alleged that an engine manufacturer participated in a vehicle manufacturer's intentional statutory violation. The court held that the complaint failed because it did not sufficiently demonstrate the decision-relevance of the alleged legal errors, specifically noting that the defendant was an engine manufacturer and not a vehicle manufacturer, and the plaintiff failed to substantiate how the engine manufacturer could have participated in the vehicle manufacturer's intentional breach. The plaintiff bears the costs of the proceedings, and the subject-matter value is set at up to 40,000 €.
