Insurance policy EU guideline conformity and good faith arguments not requiring preliminary reference to CJEU
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiffs' complaint against the refusal to admit revision, thereby upholding the lower court's judgment and leaving the Oberlandesgericht München’s decision in force. The dispute, with a value in dispute of approximately €25,000, involved insurance law, where the plaintiffs challenged the applicability of EU policy model guidelines and the doctrine of good faith (Treu und Glauben) in the context of an insurance policy. The Court held that the conformity of the policy model with EU guidelines was not decisive for the outcome, citing established jurisprudence that a preliminary reference to the Court of Justice of the European Union regarding the good faith argument was unnecessary. Furthermore, the Senate assessed that the intended revision had no prospects of success, thereby denying access to appellate review under § 543 Abs. 2 ZPO and imposing the costs of the complaint proceedings on the plaintiffs.
