Admission of revision on insurance guideline compliance and estoppel without prior ECJ referral
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (IV Civil Senate) dismissed the plaintiff's complaint against the non-admission of appeal, thereby upholding the lower court’s decision and leaving the plaintiff to bear the costs of the complaint proceedings. The dispute involved an insurance contract claim where the plaintiff challenged the outcome based on issues of the guideline-compliance of the policy model and the application of the estoppel doctrine (Treu und Glauben). The Court held that the guideline-compliance was not material to the decision and that a reference to the European Court of Justice regarding the estoppel argument was unnecessary, while affirming that the appeal lacked prospects of success; the matter was resolved under §§ 543 Abs. 2 and 544 Abs. 6 ZPO concerning the requirements for admitting a revision.
