Non-admission of civil revision due to lack of fundamental importance and absence of legal development grounds
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff’s complaint for non-admission of appeal, thereby upholding the prior judgment of the Oldenburg Higher Regional Court; the plaintiff bears the costs of the proceedings. The case involved a civil dispute where the plaintiff sought to establish that the subject matter was of fundamental importance or required further legal development to justify admission to revision proceedings, failing to demonstrate grounds under Section 543(2) Sentence 1 of the Code of Civil Procedure (ZPO). The Court held that the issues did not meet the threshold for review, noting that the lower court had provided independent, sufficient legal justifications and referring to the reasoning in a related prior decision (XI ZR 395/21) regarding the lack of admissible grounds for appeal.
