Challenge to refusal of admission for appeal: Absence of fundamental legal significance and reliance on independent appellate grounds
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiff's complaint for non-admission of appeal, confirming that the lower court’s appeal-admission decision remains in force and leaving the plaintiff to bear the costs of the appellate proceedings. The dispute involved a civil matter where the plaintiff challenged the appellate court’s refusal to allow a further appeal to the BGH, arguing issues of fundamental legal significance. The court held that no such significance existed and that the need for legal development or uniform jurisprudence was not met, explicitly relying on its prior jurisprudence (BGH, XI ZR 395/21) and noting that the appellate court’s decision rested on additional, unchallenged independent grounds that lacked proper argumentation for admission under § 543 Abs. 2 Satz 1 ZPO.
