Inadmissibility of criminal complaint against OLG detention orders under § 304 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Dismissed the convicted person's complaint against three orders issued by the Oberlandesgericht Bamberg, holding the appeal inadmissible and leaving the prior orders in force. The dispute concerned the appealability of specific decisions regarding provisional detention or procedural measures in a criminal proceeding. The court ruled that these particular orders were not subject to the specific type of legal remedy (Beschwerde) employed by the appellant under Section 304 Paragraph 4 Sentence 2 Half-Sentence 1 of the Code of Criminal Procedure (StPO), rendering the filing procedurally defective and denying the appointment of counsel.
