Non-admission of revision in product liability: Burden of proof for switching device defects under § 823(2) BGB and EG-FGV
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice dismissed the plaintiff's complaint for non-admission of revision, thereby upholding the lower appellate court's ruling in favor of the defendant. The dispute concerned a tort claim under § 823 Abs. 2 BGB in conjunction with §§ 6 Abs. 1, 27 Abs. 1 EG-FGV, alleging product liability issues regarding a switch-off device’s differing operational modes between test stand and normal operation. The court ordered that no decision on the substantive legal question was necessary because the plaintiff failed to effectively challenge the appellate court’s finding that the plaintiff had failed to meet the burden of proof regarding the alleged defect. The complaint for non-admission was rejected under § 543 Abs. 2 Satz 1 ZPO as the matter lacked fundamental legal significance, and the asserted violations of fundamental procedural rights were deemed unsubstantiated; the plaintiff was ordered to bear the costs of the proceedings, with the amount in dispute set at up to €45,000.
