Denial of legal aid for complaint against refusal of admissibility-based legal aid; no violation of right to be heard
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the applicant’s renewed motion for legal aid to file a complaint for denial of hearing (Anhörungsrüge) against a prior Senate decision, ruling that the motion lacked prospects of success and referring to the reasons in an earlier order; consequently, the applicant did not prevail in obtaining further relief. The dispute concerned the applicant’s procedural attempt to challenge a previous court order that had denied legal aid for an intended, though statutorily inadmissible, appeal (Rechtsbeschwerde), with the applicant further contesting the absence of the original signed judgment from the court file. The decisive legal basis was Section 114 Paragraph 1 Sentence 1 of the Code of Civil Procedure (ZPO), which denies legal aid when the intended legal action lacks reasonable prospects of success; the court determined that the underlying appeal was inadmissible as a matter of law, rendering the complaint for denial of hearing and the associated legal aid request futile, and noted that the original judgment is properly retained in the Senate book rather than the main court file.

Februar 2012 - I ZR 81/10, GRUR 2012, 945 Rn. 14; vom 12. Januar 2017 - I ZR 253/14, GRUR 2017, 397 Rn. 24).
