Necessity of EU reference for good faith defense in insurance policy disputes and admissibility of revision for lack of fundamental significance
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff’s complaint against the non-admission of revision, leaving the judgment of the Higher Regional Court in force and ordering the plaintiff to bear the costs of the appellate proceedings. The case involved a dispute concerning the compliance of an insurance policy model with EU directives and allegations of a breach of good faith (Treu und Glauben). The court held that the issue of directive conformity was not decisive for the outcome and that a reference to the European Court of Justice regarding the good faith objection was unnecessary; furthermore, after assessing the prospects of success, the court determined that the revision did not meet the requirements for admission under § 543 (2) Sentence 1 ZPO, as the matter lacked fundamental legal significance and did not require the development of law or the assurance of uniform jurisprudence.
