Non-admission of revision in insurance dispute: lack of fundamental significance regarding EU directive compliance and estoppel defense
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, leaving the decision of the Hamm Higher Regional Court in force; consequently, the plaintiff lost the case and bears the costs. The dispute concerned an insurance contract where the plaintiff alleged that the policy model was non-compliant with European Union directives and raised a defense of estoppel (venire contra factum proprium). The court determined that these issues were not decisive for the outcome, that a preliminary ruling from the Court of Justice of the European Union was unnecessary, and that the appeal lacked the prospects of success required to warrant a full review on the merits.
