Validity of verdict service and completion of main hearing protocol in electronic case files
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's appeal as unfounded, upholding the judgment of the Landgericht Mannheim dated September 19, 2025, and ordered the defendant to bear the costs of the appeal. The primary legal issue concerned the validity of the service of the verdict and the completion of the main hearing protocol, specifically whether the accidental omission of one annex from the protocol’s digital transfer prior to the service order by the presiding judge on November 13, 2025, rendered the service ineffective. The court held that the service was valid under § 273 Abs. 4 StPO because the protocol, signed on November 6, 2025, had been converted to an electronic document and signed with a qualified electronic signature in accordance with § 32e Abs. 3 StPO before the service order; the decisive factor for completion was that the presiding judge and court clerks deemed the protocol complete, a fact evidenced by their signatures and the transfer of the original into the electronic case file.
