Food labeling liability under § 823 Abs. 2 BGB and EG-FGV: rejection of non-admission complaint due to absence of fault
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint for admission of appeal (Nichtzulassungsbeschwerde), upholding the appellate court's decision and ordering the plaintiff to bear the costs, as the case lacked fundamental significance or a need for legal unification. The dispute concerned a tort claim under § 823 Abs. 2 BGB in conjunction with § 6 Abs. 1 and § 27 Abs. 1 of the Food Law Act (EG-FGV) and related EU law provisions, where the plaintiff argued that procedural fundamental rights were violated. The court found no admissible ground for revision, specifically holding that the appellate court’s finding that the defendant lacked fault (Verschulden) sufficiently grounded the dismissal of the claim, and thus the procedural defects alleged did not require a higher court review.
