Liability of motor manufacturer for vehicle manufacturer's intentional emissions fraud under § 823 Abs. 2 BGB; non-admission of revision
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice dismissed the plaintiff’s non-appealable complaint against the lower court’s refusal to admit a revision appeal, upholding the appellate court’s judgment which denied damages. The dispute concerned a claim for damages under German tort law arising from the emission scandal, where the plaintiff attempted to hold a motor manufacturer liable for the vehicle manufacturer’s alleged intentional violation of emission regulations. The court ruled that the plaintiff failed to demonstrate the decisional relevance of the alleged grounds for admission, specifically because the motor manufacturer could not be liable for participating in the vehicle manufacturer’s intentional statutory breach. Consequently, the complaint was rejected for lack of fundamental legal significance, and the plaintiff was ordered to bear the costs of the complaint proceedings.
