Admissibility of revision complaint in insurance dispute: rejection due to lack of fundamental legal significance
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (IVth Civil Senate) rejected the defendant's complaint for leave to appeal, upholding the lower court's refusal to admit a revision regarding an insurance matter, thereby leaving the Oberlandesgericht Celle judgment of September 2, 2021, in force; the court determined that the case lacked fundamental significance, did not require legal development, and did not need to ensure uniform jurisprudence under Section 543(2) Sentence 1 of the Code of Civil Procedure, while also dismissing a constitutional hearing grievance and ordering the losing party to bear the costs of the appeal proceedings.
