Criminal appeal deadline expiration on a public holiday observed at the court's seat but not at the attorney's location
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) granted the defendant reinstatement to the previous legal position regarding the missed deadline for filing procedural objections, subsequently rejecting her appeal against the Düsseldorf Higher Regional Court’s judgment of February 11, 2025, as unfounded and ordering her to bear the costs of the appellate proceedings. The dispute centered on whether the statutory deadline for lodging an appeal, which expired on June 19, 2025, was automatically extended because the date fell on a public holiday; the defendant argued the deadline should have shifted despite the holiday not being recognized at her defense attorney's office location. The court’s decisive legal basis was Section 43(2) of the Code of Criminal Procedure (StPO), which stipulates that deadlines expire on a public holiday if the holiday is observed at the seat of the court where the deadline must be observed (here, North Rhine-Westphalia), rendering it immaterial that the holiday was not recognized at the attorney’s location in Bremen, thereby triggering reinstatement under Sections 44 and 46 StPO for the procedural objections only, while the substantive appeal remained meritless.

Revisionsbegründungsfrist: Fristablauf am Feiertag
[TENOR]
Aufl., § 43 Rn. 3).
