Legislator-Zusammenfassung

The defendant's complaint against the refusal to admit an appeal on points of law (Revision) was dismissed, leaving the judgment of the Higher Regional Court in force; the court found the case lacked fundamental significance, did not require legal development or the securing of uniform case law, and further determined that the defendant's constitutional complaint regarding a violation of the right to be heard was unfounded. The dispute concerned a civil matter within the competence of the 4th Civil Senate, where the appellate court's non-admission of the appeal was challenged on grounds of legal importance and procedural fairness. The decisive legal basis for the dismissal was § 543 Abs. 2 Satz 1 ZPO regarding the criteria for admitting an appeal on points of law, and the application of § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO to waive a detailed justification, while the rejection of the hearing complaint relied on Article 103 Abs. 1 GG.
