Admission of revision for lack of fundamental legal significance and denial of detailed reasoning under § 544(6) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure dismissed the defendant's complaint against the non-admission of a revision appeal, thereby upholding the judgment of the Celle Higher Regional Court and ordering the defendant to bear the procedural costs. The dispute, valued at up to €65,000, concerned a civil matter in which the defendant argued that the appellate court's refusal to admit a revision lacked sufficient legal grounding. The court determined that the case neither possessed fundamental significance nor required a decision by the revision court for the development of law or the assurance of uniform jurisprudence, citing the absence of successful revision prospects and rejecting the defendant's hearing rights grievance under Article 103(1) of the Basic Law pursuant to § 543(2) and § 544(6) of the Code of Civil Procedure.
