Legislator-Zusammenfassung

The Federal Court of Justice (4th Civil Senate) dismissed the defendant's complaint against the refusal to grant leave for appeal in a civil dispute, thereby upholding the appellate court's earlier decision and leaving it in force, with the defendant ordered to bear the costs of the complaint proceedings. The case involved an insurance law matter where the defendant challenged the appellate court's decision not to admit a revision appeal to the supreme court. The court determined that the case lacked fundamental legal significance, did not require the development of law, and did not need a supreme court decision to ensure uniform jurisprudence under § 543(2) Sentence 1 German Code of Civil Procedure (ZPO), noting that the prospects for a successful revision appeal had been examined and found lacking.
