The Federal Court of Justice (BGH) 3rd Criminal Senate dismissed the defendant’s appeal as unfounded, upholding the judgment of the Koblenz Regional Court of July 23, 2025, and ordered the appellant to bear the costs of the proceedings. The case involved a criminal conviction where the defendant challenged the trial court’s procedural handling of a motion for expert evidence, arguing that the court failed to fully grasp the scope of the request regarding camera activity data on a mobile phone, thereby erroneously rejecting the motion under §§ 244 Abs. 3 Satz 3 Nr. 3, Abs. 6 Satz 1 StPO. The Senate ruled that the appellate review revealed no legal error to the defendant’s detriment, finding that the trial court’s interpretation of the motion—limiting the evidentiary target to the already established lack of camera storage and deeming the inference about the specific device a matter of its own discretion—was legally permissible, and noting that the defendant had sufficient opportunity to clarify or modify the request during the main hearing had the intent been different, consistent with the doctrine of formalized dialogue in criminal proceedings.

Cited as the legal basis for dismissing the revision as unfounded because the review of the judgment based on the revision grounds did not reveal any legal error to the detriment of the defendant.

September 1997 - 5 StR 237/97, BGHSt 43, 212, 215; vom 19. Dezember 2018 - 3 StR 516/18, NStZ 2019, 547 Rn. 7; Urteil vom 10. Juni 2008 - 5 StR 38/08, BGHSt 52, 284 Rn. 17).
