Legislator-Zusammenfassung

KI-generiert

The Federal Court of Civil Procedure dismissed the defendant’s second attempt to file a hearing complaint (Anhörungsrüge) as inadmissible, ordering the defendant to bear the costs of the proceedings and stating that no further response to subsequent submissions in this matter would be issued. The dispute arose from a procedural challenge to a prior court order dated May 12, 2023, which had already dismissed the defendant’s initial hearing complaint. The court ruled that a further hearing complaint is statutorily prohibited, as the remedy is exhausted upon the first decision. The decisive legal basis is the prohibition against successive hearing complaints, supported by analogous application of Section 97(1) of the Code of Civil Procedure for the cost allocation.
