Admissibility of complaint for leave to appeal regarding severable declaratory claims and auxiliary reasoning
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) granted leave for appeal (Nichtzulassungsbeschwerde) only to the extent that the appellate court ruled against the plaintiff regarding specific claims, while rejecting the remainder of the complaint as inadmissible under § 552(1) Sentence 2 ZPO; consequently, the reversal on substantive matters is limited to those specific claims, whereas the dismissal of the declaratory claims as lacking sufficient specificity remains in force. The dispute centered on the admissibility and merit of declaratory relief claims (Feststellungsanträge) in a civil proceeding, where the appellate court had found them insufficiently defined and, in the alternative, unfounded. The decision rests on the doctrine that such declaratory claims are an independent and severable part of the dispute (selbständiger und abtrennbarer Teil des Streitstoffs), meaning that where a complaint fails to demonstrate a ground for admission regarding this specific severable portion, it is inadmissible in its entirety for that part, and alternative auxiliary reasoning provided by the lower court is treated as not written for the purposes of admission review.

BGH, Beschluss vom 17. Dezember 2020 - I ZR 88/20, juris Rn. 18 mwN).
BGH, Beschluss vom 17. Dezember 2003 - V ZR 343/02, NJW 2004, 1048 f.).
