The Federal Court of Justice dismissed the plaintiff's complaint for leave to appeal, upholding the appellate court's refusal to grant revision and ordering the plaintiff to bear the costs, with the plaintiff prevailing in no aspect of this final procedural stage. The dispute involved a claim for damages under § 823 para. 2 BGB in conjunction with the European Community Regulation on Fuel Quality and Carbon Intensity (EG-FGV), where the plaintiff sought to hold a defendant, identified as a motor manufacturer rather than a vehicle manufacturer, liable for a tortious violation of the regulation. The court held that the complaint failed to demonstrate the material relevance of the admitted grounds for review, specifically because the plaintiff did not sufficiently substantiate an allegation of intentional statutory violation by the vehicle manufacturer that the motor manufacturer could have joined as a participant.
