Engine manufacturer liability for vehicle emissions fraud: unproven participation in intentional statutory violation under § 823 Abs. 2 BGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, resulting in the appellate court's decision upholding the defendant's position. The dispute concerned a claim for damages based on the "dieselgate" emissions scandal, where the plaintiff alleged that the defendant, an engine manufacturer, participated in the intentional violation of vehicle emissions regulations by the vehicle manufacturer. The court held that the plaintiff failed to adequately demonstrate the decision-relevance of the grounds for admission, specifically failing to prove the defendant's participation in a deliberate statutory violation attributable to the vehicle manufacturer, and therefore found no fundamental legal significance or need for uniform jurisprudence under German Civil Procedure Code § 543(2).
