Non-admission of appeal for lack of decisional relevance where lower court relied on independent absence of damage grounds
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure dismissed the plaintiff's complaint for non-admission of leave to appeal, upholding the appellate court's decision. The dispute concerned a civil liability claim where the appellate court found that the plaintiff failed to establish any damage, rendering the lower judgment self-sufficiently supported and immune from the legal errors alleged in the complaint. The Federal Court ruled that the complaint failed to demonstrate sufficient decisional relevance for the legal questions raised under the grounds of fundamental significance or legal development, as required by Section 543(2) of the Code of Civil Procedure, and denied the application of Section 544(6) regarding further reasoning. Consequently, the appellate decision stands, and the plaintiff is ordered to bear the costs of the proceedings.

Das Berufungsgericht hat seine Entscheidung selbständig tragend auf Erwägungen zum Fehlen eines Schadens gestützt. Die Beschwerde legt insoweit einen durchgreifenden Zulassungsgrund nicht dar.
