The Federal Court of Justice (BGH) 2nd Criminal Senate dismissed the appellant's complaint as inadmissible and rejected his application for access to the case file and a deadline extension, resulting in a procedural defeat for the appellant and leaving the lower court’s prior order in force. The dispute arose from the appellant's attempt to challenge a decision of the Oberlandesgericht Hamm, which had previously addressed a procedural matter, and his subsequent request for file access following the alleged final closure of the criminal proceedings. The court ruled that the appellate court lacked jurisdiction to grant file access after the procedure concluded, as such authority devolved exclusively to the public prosecutor under § 147 Abs. 5 StPO, and further determined that an obviously inadmissible or statutory-invalid appeal does not confer a right to file access, citing established case law (e.g., BGH 2 ARs 327/19) to deny the request and the associated extension.

Cited as the legal basis for declaring the complaint inadmissible because the lower court's decision was not subject to appeal under that provision.
